Official Rules for the Timothy B. Schmit Giveaway Contests

Sponsor: The Timothy B. Schmit Giveaway Contest ("Giveaway") is sponsored by Lucan Records ("Sponsor"), 824 Moraga Drive, Los Angeles, CA 90049

Giveaway Contest Period:
Beginning November 1, 2003, at 12:01 am PST through December 31, 2008, at 12:01 am PST, Sponsor will be offering giveaways, featuring items such as "Feed The Fire" posters, CD singles and photos, autographed by Timothy B. Schmit. To enter, you must complete the Sign-up form on the www.timothybschmit.com web site.

How To Enter:
NO PURCHASE NECESSARY. To enter, electronically register via the "Sign-Up" page at www.timothybschmit.com. Signing up automatically registers you for a chance to win giveaways, including "Feed The Fire" posters, CD singles and photos, autographed by Timothy B. Schmit. It is not necessary to sign up multiple times and doing so will not increase your chances of winning. Signing up once makes you eligible for all current and upcoming contests. Winners can only win an autographed item one time.

LIMIT: ONE ENTRY (PER GIVEAWAY) PER PERSON, HOUSEHOLD, FAMILY AND/OR E-MAIL ADDRESS.
Sponsor is not responsible for lost, late, incomplete, illegible, or misdirected entries, or for any problems of any kind whether mechanical, human, or electronic, including, but not limited to, computer, telephone, cable, network, satellite, electronic, or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, or service provider/Internet/web site/use net accessibility or availability, traffic congestion or unauthorized human intervention. Giveaway entries are the property of Sponsor.

E-mail Change Of Address Policy:
It is your sole responsibility to notify Sponsor in writing if you change your e-mail address. To do so, either email info@timothybschmit.com or write to Lucan Records, 824 Moraga Drive, Los Angeles, CA 90049

Selection of Winners:
Winners will be selected within 30 days after the expiration date of each contest. Winners will be chosen at random from submitted, qualified web entries (a web entry is a completed Sign-up form on www.timothybschmit.com).All entries received outside the given dates will be entered into the next drawing.

Drawing & Odds of Winning:
Prize winners will be selected by the Sponsor in a random drawing from all entries received. The number of eligible entries received will determine the odds of winning.

Prizes/Giveaways:
Winners chosen in each random drawing will receive one of the prizes displayed during the particular contest for which the user registers, at Lucan Records' discretion. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. In the event of a dispute, potential winner may be required to provide proof that the potential winner is the authorized account holder of the email address associated with the potentially winning entry. All winners will be notified by email by Lucan Records' personnel, with further details regarding their prize. In the event of noncompliance by the winner, an alternative winner may be awarded the prize.

Awarding of Prize/Giveaways:
Winners of the Giveaway will be notified by e-mail (the "Notification") within 30 days of the drawing.

Sponsor may require each winner to provide proof that he or she is the authorized account holder of the e-mail address used to enter the Giveaway. In the event of a dispute regarding online submission, the entry will be deemed submitted by the authorized account holder. "Authorized Account Holder" means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or organization (e.g., business, educational, institutional) that is responsible for assigning e-mail addresses for the domain associated with such e-mail address.

Prizes are not transferable. Non-compliance with these Official Rules or our Terms of Service or undeliverable notification may result in disqualification and selection of an alternate winner.

Eligibility:
You must be 13 or older to enter. If you are under 18 years of age, see our Minor Policy below. Employees of Lucan Records, its affiliates, subsidiaries, advertising and promotion agencies, manufacturers or distributors of giveaway contest materials, and their respective officers, directors, shareholders, agents, representatives and members of their immediate family are not eligible. All applicable federal, state and local laws and regulations apply. NO PURCHASE NECESSARY.

Minor Policy:
Entrants between the ages of 13 and 18 must provide the e-mail address of their parent or legal guardian. Minors under the age of 18 who are selected to win a prize will also be required to provide Sponsor with a Parental Permission Form, which will be sent to the email address of the parent of legal guardian. The Form must be signed by the parent or legal guardian and returned by fax or mail to an address or fax number provided on the Form within 7 days of notification to be eligible to receive a prize. Any minor who does not provide the Parental Permission Form within 7 days will forfeit the right to be awarded a prize, and an alternate winner will be selected.

Conditions:
The Giveaway is governed by these Official Rules. By participating, entrants agree to these Official Rules and understand that the results of the Giveaway are final in all respects. All decisions regarding the Giveaway including, but not limited to, winner selection, will be made by the Sponsor, whose decisions shall be final and binding in all respects. Sponsor is not responsible for (i) lost, late, delayed, misdirected, unintelligible, or incomplete electronic mail; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Sponsor which may cause the Giveaway to be disrupted or misused; or (v) any inaccurate information caused by any reason, including, without limitation, the timothybschmit.com website, users, equipment, or human or technical errors relating to the submission of entries. By participating in the Giveaway, you agree to release and hold Sponsor, its promotional and advertising agencies and their respective officers, directors, shareholders, employees, affiliates, representatives and agents harmless from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the Giveaway or resulting from acceptance, possession, use, or misuse of any prize, including, without limitation, personal injuries, death and property damage, and any claims based on publicity rights, defamation, or invasion of privacy.

IN NO EVENT WILL SPONSOR, ITS PROMOTIONAL AND ADVERTISING AGENCIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE FOR DAMAGES OR LOSSES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO YOUR USE OF THE TIMOTHYBSCHMIT.COM WEB SITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE TIMOTHYBSCHMIT.COM WEB SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS OFFERED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

The Giveaway may be modified, canceled, terminated, or suspended in whole or in part without prior notice for any reason, including, without limitation, computer virus, bugs, non-authorized human intervention, mechanical or electronic problems or other causes beyond the control of Sponsor which corrupt or impair the administration, security, fairness or proper play of the Giveaway. However, in case of cancellation, termination, or suspension, prizes will still be awarded. In the event of early termination of the Giveaway, all prizes will be awarded in a random drawing from among all eligible entries received through the date on which the Giveaway is terminated. Offer void where prohibited and subject to federal, state and local laws.
